Question: Does HIPAA prevent practices from e-mailing patients?


Answer: No, HIPAA does not prevent physicians or practices from using any form of communication, including e-mail. You do need to take “reasonable and appropriate” safeguards to make sure and PHI information is protected (e.g. encryption or a patient portal). Remember HIPAA is there for the protection of a patients PHI, not to prevent communication between a patient and physician.
